WEATHER GUARD® Rewards Official Program Terms and Conditions Section 1: WEATHER GUARD® Rewards Program Rewards: Participants are eligible for a SPIF reward on the sale of select WEATHER GUARD® Van & Truck Equipment products.
A Sales Representative(SR) is defined as the person at the automotive dealership primarily responsible for the sale of WEATHER GUARD® van & truck products to the end user customer.
SPIFs are available on new WEATHER GUARD® van & truck product sales only.
Discontinued WEATHER GUARD® van & truck products purchased from Knaack LLC within a year of the installation invoice date are also eligible under the reward program.
Service and warranty parts are excluded. To qualify, eligible products must be sold after April 1, 2014.
Program is limited to automotive dealerships and claimant located within the United States only.
Eligible products and reward values per product sold will vary throughout the life of the program, and assigned based on the date of sale; details on the SPIF value for products sold are posted on the Rewards Program claim website at www.weatherguardrewards.com Eligible Products: Any new WEATHER GUARD® Van product or new WEATHER GUARD® Truck toolbox in-Bed Storage unit and ladder rack.
See website for official list. Eligibility: Program participation is available to individual Sales Representative who are employed by a company registered with Knaack LLC.
Claimant must be a valid, registered participant at the time of the sale. Equipment sales are not retroactive.
How to apply for your reward: All participants must claim for their reward on the WEATHER GUARD® Rewards website www.weatherguardrewards.com.
Individual claims must be submitted per end-user sales transaction. To qualify for the reward the following conditions must exist: • A sale is defined as an eligible WEATHER GUARD® van & truck product that is ordered and installed within the program dates. • A copy of the invoice to the end user for each claim is required for auditing purposes and should be uploaded on the claim site upon submission of each claim.
Earnings will not be rewarded until proper documentation is received. Packing slips, quotes, purchase orders (PO's) will not qualify. Invoices from an approved Knaack LLC Distributor may be submitted as proof of purchase on claims. • To be eligible for a SPIF award, products can only be purchased from an approved Knaack distributor.
• Claims and supporting documentation must be submitted within 90 days of date on invoice to end user. • Claims will be paid at the SPIF amount current at the time the product was sold. • Product returns will cause forfeiture of awards and/or may limit distribution of future prizes claimed, but not disbursed. • WEATHER GUARD® SPIF awards are non-transferable. • Visibly altered documentation will not be accepted.
Trading of proof of payment is strictly prohibited. Use of fictitious names, addresses, organizations to obtain a reward is fraud and in violation of Federal Law and may result in prosecution. • Participants who change employers must notify the program administrator of the change before making any claims or those claims will be excluded.
• The program is open only to sales personnel of vehicle dealerships for selling WEATHER GUARD® Van & truck Equipment to customers purchasing a new or used vehicle.
• Employees of Knaack LLC, its representatives, distributors, up-fitters are ineligible for the program. • Fleet orders are not eligible for a SPIF. • Ordered processed under the CBR process are excluded. All claims are subject to verification. Any false, incomplete, illegible or unverifiable claims will be rejected.
Knaack LLC has the final say as to claim validity. All “Common Terms and Conditions” expressed in section 2 (below) are applicable. Section 2: Common Terms and Conditions Program Enrollment: All eligible parties will need to register online at the Knaack LLC WEATHER GUARD® Rewards website (www.weatherguardrewards.com).
Registration is not final until acceptance into the program is granted by the Knaack LLC WEATHER GUARD® Van Equipment Rewards Program administrator (Administrator).
Acceptance (or denial) into the program will be acknowledged within 2 business days of initial submission. Knaack LLC reserves the right, at its sole discretion, to reject any application.
United States residents must provide a valid Social Security number and date of birth upon initial registration to the Rewards Program. Only on-line applications will be accepted.
Reward cards will be sent to the home address specified by the applicant on the initial registration after the initial claim has been made.
Program Period: This Program is in effect for sales activity performed from April 1, 2014 – December 31, 2015.
The dates of all qualifying sales are determined by the date indicated on the invoice to the end user (reseller to consumer).
Knaack reserves the right, at its sole discretion, to modify eligible activities, reward values, the terms of the Program or to cancel the Program at any time.
In the event the Program is canceled, participants will have up to sixty (60) days from the end of the Program to redeem earned balances.
After sixty (60) days, outstanding balances earned by the participants up the point of cancellation will be forfeited by the participant and earnings will be returned to Knaack.
Alternatively, Knaack may, at its sole discretion, issue checks to the participant for the outstanding balance.
Reward Issuance: Awards are funded to a WEATHER GUARD® Visa® debit card. The same Visa debit card may be utilized as part of additional incentives Knaack LLC chooses to run during the year.
The Knaack LLC WEATHER GUARD® Visa® debit card will be loaded monthly.
The Program Card is not a credit card, but a proprietary form of debit card.
All participants must comply with the terms and conditions included in the statement provided with the Card.
Program participants are not allowed to spend funds in excess of amounts credited to the Card, or earned funds in advance of actual Card funding.
Use of the Knaack LLC WEATHER GUARD® Visa® debit card is governed by separate and specific Terms and Conditions, which will accompany the card at time of issuance.
• This promotion is void where prohibited by law, government regulatory provisions or reseller business policies or procedures.
It is the recipient’s responsibility to ensure that the acceptance of the prize does not violate any laws or regulations of any kind, including but not limited to any conflict of interest or gift policies in effect at recipient’s company or organization.
• The participant is responsible for federal, state and local income taxes on all rewards earned.
Knaack must complete an IRS form 1099 and send it to you for any year in which your award earnings are more than $600.
• Knaack employees are not eligible to participate.
• Award details will be provided to your employer if requested.
• Knaack reserves the right to modify any aspect or terminate this program at any time, without notice.
Knaack LLC, CCI Inc. Intelispend and Visa Inc. shall not be liable for any damage, loss, expense, injury, delay or inconvenience caused by or contributed to by any negligent or unauthorized act by any of these suppliers or any merchants who accept the prepaid Visa card, by any defect in or failure of equipment they own, operate or furnish, or any services or merchandise acquired with the prepaid Visa card, or by any other cause beyond the direct control of Knaack LLC , CCI Inc. Intelispend and Visa Inc.
Limited Liability:
In no event shall Knaack LLC and its associated vendors be responsible for product failures of any kind whether caused by the sponsor, users or by any of the equipment or programming associated with or utilized in the promotion, or by any technical or human error which may occur in the processing of submissions involved in the participation of this Program and a participant's ability to participate in the Program.
Knaack LLC may decline, prohibit or terminate any participant’s participation in the Program if, at its sole discretion, Knaack LLC determines that such participant is attempting or intending to undermine the legitimate operation of the Program by cheating, hacking, deception or other unfair practices, or annoy, abuse, threaten or harass any other participants or Knaack LLC representatives.
Consent to Collection and Use of Personal Information Collection of Data The Data Controller collecting your information below is Knaack LLC.
For the Knaack LLC WEATHER GUARD® Van Equipment Rewards Programs (“Program”), we will collect only that information specifically and voluntarily provided by you to at this web site.
We will not share your personal data with third parties, except with our service providers who may process your information for purposes of the contest, and only as strictly necessary to assist in processing your submission for the purposes described below.
Other Terms and Conditions Knaack LLC, its promotional and advertising agencies, and all respective officers, directors, employees, representatives and agents shall have no liability and shall be held harmless by Program participants for any damage, loss or liability to person or property, due in whole or part, directly or indirectly, by reason of the acceptance of and the participation in this Program.
Any controversy or claim arising out of or relating to this Program shall be settled by arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules.
The arbitrator shall be authorized to award actual, direct damages only and shall in no event be authorized to award consequential or indirect damages, exemplary or punitive damages, to conduct a class-wide arbitration or to award attorneys fees.
Knaack LLC may decline, prohibit or terminate any participant’s participation in this Program if, at its sole discretion, Knaack LLC determines that any such participant is attempting to undermine the legitimate operation of the Program.
This Program is void where prohibited and subject to local laws.
Knaack LLC reserves the sole and exclusive right to change or alter this Program at any time without prior notice.
Acceptance of Program Terms & Conditions; Release By clicking below, for good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, you hereby accept these Program Terms & Conditions, and you, on behalf of yourself and your successors, assigns, and affiliates, do hereby unconditionally remise, release, acquit and forever discharge Werner Co. and its successors, assigns, and affiliates, from any and all claims, charges, controversies, actions, causes of action, damages, and claims for relief, costs, reimbursement, expenses and attorneys' fees, or liabilities of any nature whatsoever in law and in equity, both past and present and whether known or unknown, suspected or unsuspected, matured or unmatured, related to or are otherwise connected with the Program.
